These Terms of Service ("Terms") govern your use of Feedbug's website and services. By using our service, you agree to these Terms.

1. Service Description

Feedbug provides a feedback collection widget that you can embed on your website. Feedback submitted by your visitors is stored and delivered to you via email.

2. Account Registration

To use Feedbug, you must create an account with a valid email address. You are responsible for maintaining the security of your account and all activities that occur under it.

3. Acceptable Use

You agree not to use Feedbug to:

  • Collect data in violation of any applicable laws
  • Collect sensitive personal information without proper consent
  • Send spam or unsolicited communications
  • Interfere with or disrupt our services
  • Attempt to gain unauthorized access to our systems
  • Use the service for any illegal purpose

4. Your Responsibilities

When using Feedbug on your website, you are responsible for:

  • Disclosing feedback collection to your visitors in your own privacy policy
  • Obtaining any necessary consents from your visitors for data collection
  • Ensuring your use of collected feedback complies with applicable laws
  • Configuring allowed domains correctly to prevent unauthorized use of your API key

5. Subscription and Payment

Feedbug is offered as a paid subscription service. By subscribing:

  • You authorize us to charge your payment method on a recurring basis
  • Subscriptions renew automatically unless cancelled before the renewal date
  • You can cancel your subscription at any time through the billing portal
  • Refunds are provided at our discretion; contact us if you believe you deserve one

6. Free Trial

We offer a 14-day free trial for new users. During the trial, you have full access to all features. If you do not cancel before the trial ends, your subscription will begin and you will be charged.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue any part of the service at any time with reasonable notice.

8. Data Ownership

You retain ownership of all feedback data collected through your use of Feedbug. We do not claim any ownership rights over your data. Upon account termination, you may request export of your data.

9. Intellectual Property

Feedbug and its original content, features, and functionality are owned by us and are protected by copyright, trademark, and other intellectual property laws.

10. Limitation of Liability

To the maximum extent permitted by law, Feedbug shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service.

Our total liability for any claims arising from these Terms or your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Feedbug from any claims, damages, or expenses arising from your use of the service or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason with notice. Upon termination, your right to use the service ceases immediately.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or through our service. Continued use after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in San Francisco, California.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Feedbug regarding your use of our service.
